2. Use of the Platform

2.1 Users may access and use the Platform to:

  • Submit or manage a request to find a replacement tenant (Contractual Partners)
  • Apply for available rental properties (Applicants)

2.2 The Platform may only be used for its intended purpose. Any misuse, automated scraping, or data harvesting is strictly prohibited.

3. Terms for Applicants

3.1 By submitting an application via namsu.ch, Applicants agree to:

  • Provide truthful and complete information
  • Allow Namsu to evaluate and forward their application to relevant landlords or tenants
  • Accept that Namsu does not guarantee placement or feedback

3.2 Applicants acknowledge that:

  • Namsu acts solely as an intermediary and not as a party to any rental agreement
  • All rental decisions are made by landlords or current tenants, not Namsu

3.3 Habitabell ApplicantsApplicants who are redirected from habitabell.ch and submit their application as part of the digital brokerage process are subject to additional obligations, including a broker fee in the event of a successful rental agreement. These obligations are governed by a separate agreement concluded on habitabell.ch. Before submitting an application, such users are reminded of those separate contractual terms. In the event of a conflict between the habitabell agreement and these General Terms, the habitabell agreement shall take precedence.

4. Terms for Contractual Partners (Tenants)

4.1 The use of services involving a contractual guarantee or payment by Namsu, such as the tenant replacement guarantee, is subject to a separate set of contractual terms accepted during onboarding.

4.2 These General Terms apply in addition to such specific contract terms and govern general platform usage.

5. Data Protection

5.1 The handling of personal data is governed by Namsu’s Privacy Policy, available at [insert link].

5.2 By using the Platform, users consent to the processing of their personal data as described in the Privacy Policy.

6. Intellectual Property

All content, trademarks, logos, and software on the Platform are the intellectual property of Namsu or its licensors. Unauthorized copying, distribution, or use is prohibited.

7.1 Namsu strives to maintain the availability and security of the Platform but does not guarantee uninterrupted operation or error-free functionality.

7.2 Namsu shall not be liable for:

  • Decisions made by landlords or tenants regarding rental applications
  • Accuracy or completeness of information submitted by users
  • Any indirect or consequential damages arising from Platform use

8. Final Provisions

8.1 Namsu may amend these Terms at any time. The current version is published on the Platform.

8.2 Swiss law applies exclusively. Jurisdiction is the registered seat of Namsu GmbH.

8.3 Should any provision be held invalid, the remainder of the Terms shall remain in force.

9. Language

In the event of discrepancies or ambiguities between different language versions of these General Terms of Use, the German version shall prevail.
